Updated June 3rd 2024.

TERMS OF SERVICE

If you want to access or use the LEGO Ideas website (“Site”), you must agree to be bound by these Terms of Service. Please read these Terms of Service carefully before using the Site. The Terms of Service tell you who we are, how we will provide our services to you, how you or we may change or end the contract that these Terms of Service constitute between us, and other important information. If you think that there is a mistake in these Terms of Service [or require any changes], please contact us through our customer service to discuss. By accessing or using the Site, you unconditionally accept and agree to comply with these Terms of Service.

I. GENERAL

Who are we?

We are LEGO System A/S, Aastvej 1, DK-7190 Billund, Denmark, Central business registration number 47458714 (“LEGO Group” or “we”). LEGO System A/S is part of the LEGO Group of companies. Read more about us here. When we refer to the LEGO Group in these Terms of Service, this automatically includes a reference to LEGO System A/S as well.

The LEGO Ideas website is a place where users can share their cool creations and show off their creativity, enter challenges, showcase the submissions for new LEGO Ideas sets (“Product Ideas”) and vote for awesome models dreamt up by fellow fans.

II. ACCESSING THE SITE

To access the Site, you must be at least 16 years old.

To submit Product Ideas, Challenge submissions, vote on submissions, comment on posts, or engage in other activities, you will be required to establish a LEGO Account. All accounts must be tied to a bona fide email address or social networking profile you own and operate.

Users between 16 and 18 years old can create and submit Product Ideas and Challenge submissions and participate in other activities, however we will need consent from your parent/legal guardian if we decide to produce your Product Idea or if we select your Challenge submission or activity submission.

The Site and all activities contained on the Site are international, and users from all countries and from any background are eligible to participate in submitting Product Ideas, entering Challenges or are eligible to receive awards, except where prohibited by applicable laws. Active participation on the Site is not open to residents of any other country which is subjected to sanctions or where prohibited or restricted by law, for as long as such sanctions or legal restrictions remain in place.

In the event that shipping awards or granting monetary rewards to a non-sanctioned country is restricted for a period of time, awards will be shipped at a later point when normal shipping operations resume. Residents of sanctioned countries will not be eligible for any remuneration for Product Ideas or other submissions as long as sanctions remain in place.

Employees and freelance contractors of companies in the LEGO Group, agencies and companies associated with the LEGO Group (including suppliers of the LEGO Group) and the immediate families of such employees, are not eligible to submit Product Ideas or participate in Challenges on the Site.

III. DATA PRIVACY

LEGO System A/S collects, retains, and processes personal data about you in accordance with all applicable data protection laws, including the General Data Protection Regulation and applicable local data protection legislation.

You can find details regarding data collection, use, storage, retention, deletion, who we share your data with and when, as well as your rights as a data subject, in our Privacy Policy.

IV. USER GENERATED CONTENT

The Site invites you to submit your own ideas as suggestions for potential future LEGO products, to enter building Challenges, or participate in other activities (such as quizzes, polls, or mini challenges). Each of these activities (Product Ideas, Challenges, or other activities) have their own distinct set of Guidelines and Awards.

We call the submissions you make to the Site User Generated Content (“UGC”). We accept creative work as Product Ideas, Challenge submissions, and activity submissions provided it follows the guidelines mentioned below:

  • Ideas for new LEGO products, sometimes referred to as “Projects” “Ideas,” or "Product Ideas," are subject to the Product Idea Guidelines
  • Entries to specific Challenges, sometimes referred to as “Challenge Entries,” or "Entries," are subject to the respective Challenge Guidelines.
  • All user conduct on the Site is governed by these Terms of Service, the LEGO Ideas House Rules, and the LEGO Group’s Code of Conduct
  • All submissions must be made on your own behalf and not on behalf of an employer or client. Collaborations between builders are welcome, but please see the instructions for Collaborative Product Ideas in the Product Idea Guidelines

We will not consider any submissions written, developed, or assisted by the use of any artificial intelligence (“AI”) writing or image tools such as ChatGPT, DALL-E, Midjourney, etc. Attempting to submit Product Ideas, Challenge Entries or other UGC containing content generated by AI tools may result in your submission being rejected.

(i.) Assignment

In exchange for your use of the Site, and to the extent that your UGC submissions on the Site give rise to any intellectual property right interest, including copyright, patent rights, design rights etc., you hereby assign all rights worldwide to the content generated by you to LEGO System A/S, meaning that we and our co-marketing partners can use your contributions in any way and for any purpose, including to reproduce, manufacture, copy, adapt, modify, perform, display, publish, sell, broadcast, transmit, or communicate to the public by any means whether now known or unknown and distribute your contributions for the whole duration of protection granted to intellectual property rights by applicable laws and international conventions.

Although you assign the above-noted rights in your UGC submissions to us, you can continue to share and promote your work. Accordingly, we grant each submitter a limited, revocable license to make use of their submitted Product Idea, activity submission or Challenge Entry for any of the following non-commercial uses:

  • Posting pictures or other information about a submitted Product Idea, activity submission or Challenge Entry on the submitter’s own website or social media pages;
  • Displaying a model based on a submitted Product Idea, activity submission or Challenge Entry at a public event such as a LEGO fan convention;
  • Permitting a photograph or other content or information about a submitted Product Idea, activity submission or Challenge Entry to be published in a magazine or book, or in an online forum such as a fan website or a blog, provided that no compensation is paid to the submitter;
  • Inclusion of pictures or other information or content about a submitted Product Idea, activity submission or Challenge Entry in a portfolio of the submitter’s creative works;
  • Entering content or LEGO models from one’s inactive (for example expired, archived, or not approved) Product Idea, activity submission or Challenge Entry to any other contest, crowdsourcing program, or open innovation initiative offered by the LEGO Group, if allowed by that initiative’s rules;
  • Using any of the above methods to gain support on the LEGO Ideas platform, or to promote the submitter’s skill and talent.

You may not sell any items, either physical or digital items, related to the Product Ideas, activity submissions or Challenge Entries submitted to the Site. More specifically, if we learn you are selling images, building instructions, custom kits, or anything related to Product Ideas you have submitted to the platform, your materials may be deleted from the LEGO Ideas Site without further notice to you or (in some cases) we may need to pursue legal proceedings.

Should we choose to no longer consider your Product Idea submissions such as by deleting or archiving materials you have submitted, your submission expiring, or by us not selecting your Product Idea after review, all rights assigned to LEGO System A/S remain assigned to us for a further period of three years from the date of deletion. The limited, revocable license granted to the Product Idea submitter remains in effect for the same three-year period. Should we refuse your submission to the Site (whether as a Product Idea, activity submission or Challenge Entry), all rights assigned to us above immediately revert to you.

You agree that if the LEGO Group introduces a product similar to your Product Idea, activity submission or Challenge Entry, whether accepted to or rejected from the Site, you understand and acknowledge that any coincidence is unintentional, and agree to indemnify and hold LEGO System A/S harmless and release us from any and all claims of infringement.

You may choose to remove Product Idea submissions from your LEGO Ideas profile. Should you choose to delete or remove your Product Idea submissions from the Site prior to approval from us, all rights assigned to us at the time you submitted the contributions, will remain assigned to LEGO System A/S for a period of three years from the date of deletion, and the limited, revocable license granted to the submitter remains in effect for the same three-year period.

All rights assigned to LEGO System A/S related to Challenge Entries or activity submissions remain assigned to LEGO System A/S indefinitely.

(ii.) Commercialization and Compensation for Product Ideas

We choose at our sole discretion whether to commercialize your Product Idea through the Site. We will inform you of our decision and anticipated time frame for the project. There may be external factors that delay the timing, such as license negotiations with IP holders. Also, you agree to furnish further requested personal information in a timely fashion including professional headshot and bio for giving you proper credit within the project collateral to meet production deadlines.

Should we choose to commercialize your Product Idea through the Site, you will be compensated according to the Product Idea Guidelines in place at the time your project reaches 10,000 supporters. Compensation generated during a Calendar Quarter (January-March, April—June, July-September, October-December) will be paid to you 60 days after the end of the Calendar Quarter (June 1st, September 1st, December 1st, and March 1st), accompanied by a royalty report. You will not be compensated further unless dictated by mandatory rules.

You agree not to take advantage of the Site for commercial gain outside of the context of the platform. Therefore, you may not sell any items, physical or digital, related to content you have submitted and later delete or remove from the platform.

(iii.) Taxes

Reporting any compensation received, and paying any taxes due, to your home tax authorities are solely your responsibilities. LEGO System A/S is not responsible for and will not pay any taxes imposed by your home tax authorities. All payments made under these Terms of Service and the LEGO Ideas Product Guidelines shall be free and clear of any and all taxes, duties, levies, fees or other charges, except for withholding Danish taxes.

Where any sum due to be paid to you is subject to any Danish withholding tax, you shall use all commercially reasonable efforts to do all such acts and things to provide us with an applicable documentation (Certification of residence and Tax status concerning payment of Royalty form or other such documentation) evidencing your country of residency in order to enable you to take advantage of any applicable Double Taxation Agreement or Treaty. In the event there is no such applicable Double Taxation Agreement or Treaty, or if an applicable Double Taxation Agreement or Treaty reduces but does not eliminate such withholding tax, we shall deduct any withholding taxes from payment and pay such withholding tax to the appropriate Danish government authority.

Should you fail to provide relevant documentation of residency in proper time before the first payment from us, we are obliged by Danish law to withhold full Danish royalty tax regardless of any reduced tax rate in any applicable Double Taxation Agreement or Treaty. The full withheld Danish tax shall be deducted from payment to you. In such a case we are not obliged to assist you with claiming back any excess Danish tax.

(iv.) Qualification Deadline for Product Ideas

The Site will impose an initial time limit of 60 days on all Product Idea submissions to receive 100 supporters. After reaching 100 supporters, the Product Idea will be granted 365 days to continue gathering support. If a published Product Idea reaches 1,000 supporters within that time, it will be granted an additional 6 months (182 days) to reach the next milestone. If a published Product Idea reaches 5,000 supporters within this timeframe, it will be again granted an additional 6 months (182 days) to reach 10,000 supporters and thus qualify for Review.

If your submission does not reach the required number of supporters within the time limits as stated above, your Product Idea will “expire”, that is, the Product Idea will no longer accept supporters and it will automatically go into an archived state. After your submission expires (but not before), you are welcome to re-submit your Product Idea and attempt again to qualify within the time limit.

VII. CODE OF CONDUCT AND APPROPRIATE USE

The LEGO Group Code of Conduct applies to all visitors to any LEGO Group platforms, websites, or apps, including this Site. Violations of the Code of Conduct on one platform, website, or app may result in consequences on other platforms, sites, or apps.

The goal of the Code of Conduct is to establish a culture of courteous, respectful, and inclusive communication among all participants on all online platforms, websites and apps used by the LEGO Group. Our Code of Conduct prohibits harassment, bullying, and posts involving illegal content such as, for example, pro-terror material or crimes involving the health or safety of any person, among other types of prohibited content. Click here to access the Code of Conduct and learn more about what kind of behavior is permitted on this Site and what is prohibited.

How the LEGO Group Enforces its Code of Conduct

The LEGO Group enforces its Code of Conduct in various ways.

Moderation

The LEGO Group moderates its sites. This process involves classification, filtering, and moderation of UGC submitted to our sites from users, which may include online chat logs, usernames, profiles, images, video, audio, or other UGC.

When a user submits content to our sites, it is processed through software that submits the content for moderation.

For adult-targeted sites, data submitted for moderation is processed in part using AI-based automated decision making to review both text and image submissions, and this processing might involve data which could contain personal information, as well as information based on a user’s submission history. You can consult our Privacy Policy for more details about how the LEGO Group processes personal data. The LEGO Group uses two sets of machine learning models to moderate content: 1. Language detection trained by our moderation data processor using public data; 2. Images classified by our moderation data processor’s image analyzer tool. However, such automation is only one stage in the moderation process, and escalation triggers a second opinion which involves human intervention.

For child-targeted sites, the LEGO Group uses internal quality filters only and moderates using 100% human moderation.

User Reports

If you think you have seen activity that violates the letter or the spirit of our Terms or Code of Conduct, please alert our moderators:

  • Click here to report a post: Customer Service
  • Use the “Report” button on a specific post

For Australian users: You can make a complaint about content on our site directly to the Australian eSafety Commissioner. Complaints to the Australian eSafety Commissioner must be in writing and must include the following:

  • Your name and contact details;
  • Internet address of the content and any other details required to access it;
  • Description of the internet content; and
  • The reason(s) you feel the content is objectionable.

A report form can be filled in and submitted via the eSafety Commissioner website

Procedures

When content or a user is flagged as potentially being in breach of our Terms of Service, Code of Conduct, Product Idea Guidelines,  Challenge guidelines, or activity guidelines, our moderation team will review the content or activity in question to evaluate whether a breach has occurred.

We may impose the following sanctions for breaches of our Terms of Service, Code of Conduct. Product Idea Guidelines,  Challenge guidelines, or activity guidelines:

  • Content removal: Posts containing illegal content or content which the LEGO Group considers to be misleading or fraudulent will be removed as soon as they are found.  Content which we have been informed infringes another’s intellectual property rights or other proprietary rights will also be removed. Other content may be removed for breach of our Code of Conduct after review on a case-by-case basis.
  • Content editing (for example, to delete an image or specific text): If only a portion of a submission is illegal or inappropriate or in breach of our Code of Conduct, we may edit that content to remove the offending material.
  • Temporary suspension of access privileges: User accounts may be suspended for repeated violations of our Code of Conduct, for example, for repeated incidents of harassing or bullying behavior. We may also suspend the accounts of users who leak confidential information or who post misleading or fraudulent information, as well as users who make repeated unfounded complaints about other users or who abuse our reporting system.
  • Permanent blocking of access privileges: User accounts used to post certain illegal content (such as child sex abuse material) will be terminated and reported to the relevant authorities. We also reserve the right to terminate the accounts of users who repeatedly or seriously violate our Code of Conduct, or who persistently make repeated unfounded complaints about other users, abuse our reporting system, or attempt to circumvent sanctions for prior bad behavior.

Prior to imposing any of the above sanctions, we will take the following factors into account, including (but not limited to):

  • The numbers of instances of manifestly illegal or inappropriate content or manifestly unfounded notices or complaints submitted within a given time frame;
  • The relative proportion of such content in relation to the total amount of content posted or notices submitted within a given time frame;
  • The nature and seriousness of the inappropriate or illegal content including its potential or actual consequences on other users;
  • Where it is possible to identify, the intent of the individual or the complainant.

If we impose any of the above sanctions, we will inform you of the sanction and the reason(s) why, including specific references to these Terms of Service our Code of Conduct, or the applicable guidelines.

Right of Appeal

If you think that we made a mistake relating to any content takedown, removal, or account suspension or termination that affects you, you have up to 6 months to challenge our decision.

For EU users: If the results of the appeal are unsatisfactory to you, you also have the right to apply to an out of court dispute settlement body to resolve disputes relating to our decision. In Denmark the Digital Services Coordinator is the Konkurrence- og Forbrugerstyrelsen, which can hear complaints about our compliance with the requirements of the EU Digital Services Act, as well as certify an out of court dispute settlement body. You will find the Danish out of court dispute settlement body’s contact information at https://www.kfst.dk

For Australian users: If we are unable to resolve your complaint within a reasonable time, we will refer your complaint to the Australian eSafety Commissioner.
